By accessing and using the ximthorezolex.world website or participating in our candle making workshops, you agree to be bound by these Terms of Use. If you do not agree with any part of these terms, please do not use our website or services.
Consumer Guarantees and Fair Trading
If you are a "consumer" under the Consumer Guarantees Act 1993 (CGA)—that is, you are acquiring our services for personal, domestic, or household use—the guarantees and remedies under the CGA apply to you and cannot be excluded by these terms. Nothing in these Terms of Use is intended to exclude, restrict, or modify your rights under the CGA or the Fair Trading Act 1986. Where our services are supplied for business purposes, different rules may apply and we may agree in writing to contract out of the CGA in accordance with the Act.
Workshop Services
Booking and Payment
Workshop bookings are confirmed upon receipt of full payment. We accept payment via credit card, bank transfer, and cash at our studio location. Prices are listed in New Zealand Dollars (NZD) and include GST where applicable.
Workshop Participation
Participants must be at least 10 years of age. Those under 16 must be accompanied by an adult. By participating in our workshops, you acknowledge that candle making involves heated wax and other materials that require careful handling.
Safety
Participants agree to follow all safety instructions provided by our instructors. We provide protective equipment including aprons. Participants with allergies or sensitivities to fragrances or materials must inform us prior to the workshop.
Gift Vouchers
Gift vouchers are valid for 12 months from the date of purchase. Vouchers are non-refundable but may be transferred to another person. Lost or stolen vouchers cannot be replaced. Vouchers cannot be exchanged for cash.
Intellectual Property
All content on this website, including text, images, graphics, and design elements, is the property of Ximthorezolex and is protected by copyright and other intellectual property laws. You may not reproduce, distribute, or create derivative works without our written permission.
Website Use
You agree to use our website only for lawful purposes and in a manner that does not infringe upon the rights of others. You may not:
- Attempt to gain unauthorized access to our systems
- Use automated tools to access or scrape our website
- Transmit any harmful code or malware
- Interfere with the proper functioning of the website
Limitation of Liability
To the fullest extent permitted by New Zealand law, and subject always to your rights under the Consumer Guarantees Act 1993 (where you are a consumer), Ximthorezolex shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of our website or participation in our workshops. Where the CGA applies, our liability is subject to the remedies and limitations set out in that Act. For business customers who have validly contracted out of the CGA, our liability is limited to the amount you paid for the relevant service.
Indemnification
You agree to indemnify and hold harmless Ximthorezolex and its employees from any claims, damages, or expenses arising from your breach of these Terms of Use, your misuse of our website, or your failure to follow safety instructions during our workshops. This does not affect our obligations to you under the Consumer Guarantees Act 1993 or other applicable law.
Governing Law
These Terms of Use are governed by and construed in accordance with the laws of New Zealand. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the courts of New Zealand.
Changes to Terms
We reserve the right to modify these Terms of Use at any time. Changes will be effective immediately upon posting to this website. Your continued use of our services constitutes acceptance of any modified terms.
